Fair settlement

    60-60% is about right where there are children.

    Married for 18 years, 2 kids aged 15 & 11. Husband gone off with other woman but still living at home (in spare room). My solicitor is a bit wishy washy about settlement - says it could be anything between 60%-70% overall) House equity £420K after paying off mortgage (we have a detached five bedroom house). Other assets total £140K (inc. shares/ endowments/ savings). Pensions - his £116,000 mine £40,000. I am asking for 70% of assets and he keeps his pension. He seems to think that 50% is fair but I have to house 2 children. I am only looking to get a 3 bed semi which will be a drop in our standard of living. I would come out with around £360K plus £41K pension and he would get around £160 plus £116K pension. He is talking about going abroad and hinting that I can whistle for child maintenance. Any advice on whether my proposal would be considered fair in court gratefully received.
