Charging Orders and Divorce

    The charging order has the same effect as a mortgage and unless it is paid off upon transfer they normally will not accept this.

    I would be really grateful for advice on the following: I have seperated from my husband, he is currently living in our marital home, and is paying the joint mortgage. There is a charging order on the house, in my sole name, he wants to buy me out, will pay the going rate, this wont cover the amount on the charging order, could he still buy my share. Previously this has been refused? Thankyou
