How long does a Prenup take to be drafted?
We aim to professionally draft the Prenup contract for you within 31 working days, which is to your exact requirements; not using a template!
If you require a prenup sooner, our solicitors can fast-track this to 7 working days for a fee. Please contact us for more information on this.
How far in advance of marriage does a Prenup need to be signed?
The simple answer to this question is, as far in advance of getting married as possible.
Getting a prenup signed well in advance of your wedding day will help you avoid any of the questions by the court of parties being coerced or pressured into signing it.
The minimum amount of time would be 28 days, but again, this could raise some questions by a Judge if it comes to court.
What is a Post-nuptial agreement?
A post-nuptial agreement is essentially the same as a pre-nuptial agreement apart from the fact that it is signed after the marriage and not before.
Signing a postnup after you get married can help you establish a framework for a divorce settlement, which can ease the stress and cost in the future if your marriage were to breakdown.
Can I not just write my own Prenup?
No. Well, yes you can, but if draft your own prenup it will not stand up in court, therefore making it unenforceable.
A prenup is a legal contract that needs to be drafted by professionals. Free templates will not include specific legal clauses required, such as expressing what is to happen to any inheritance, properties owned before marriage, and so on.
Courts will expect both parties to have received legal advice to ensure they understand the implications of signing the prenup.
