Why Are Financial Consent Orders Necessary?
Why do you need a consent order?
- It ends all financial ties – If your ex-partner was to go into debt, for example, the courts could not pursue you or your assets.
- It prevents future claims – Neither party will be able to submit a claim against the other in the future, giving you peace of mind.
- It ensures compliance – A consent order gives the court powers to enforce specific actions if one party does not comply with the agreement.
- It gives parties a fresh start – With no possible claims looming over your head, both parties will be able to move on with a clean slate.

How long does a consent order take?
This will largely depend on the court’s workload at the time of filing, however, it should take on average between 2 and 4 weeks.
How long it takes to draft your consent order also depends on who you use to help you. With Divorce-Online we aim to prepare your financial order within 31 working days.
What assets can we divide?
Each consent order will be different. The contents of your agreement should reflect your individual circumstances.
A consent order can include a range of financial clauses such as the division of property, savings, pensions, debts, and also provide the framework for children and or spousal maintenance.
If you’re dividing any property or pensions it’s vital to obtain a financial order and have it approved by the court.
Do I actually need a solicitor?
The simple answer is yes, you do. This doesn’t mean you need to spend thousands on separate representation for both sides to squabble and pick apart your agreement.
If you have agreed upon the division of money and assets, you can use our consent order services for the drafting and application to court. One low-cost fee without the need to appear in court or visit our offices.
Is a consent order compulsory?
Many people do not understand that by ending a marriage it does not sever your financial ties as husband and wife or civil partners.
The court do not force couples to obtain a fiancial order, which means it is not compulsory, however, the consequences of not obtaining one can be vast.
Couples who are dividing important assets such as savings, property and pensions should seek to have an order approved by the court to prevent the other party from breaching the agreement.
