A civil partnership will naturally come to an end if you or your civil partner dies.

How do you end your civil partnership?

If you want to end your civil partnership before one of you dies, you need to apply to a court for the civil partnership to be dissolved, a process very much like a divorce. But this type of court order is called a civil partnership dissolution.

If you have children, you will have to sort out arrangements for the children when you end a civil partnership.

While applying for a a civil partnership dissolution you might also need to sort out financial arrangements to deal with any assets or property you own and wish to split. This is done by way of a consent order.

Applying for dissolution of civil partnership

The process of ending a civil partnership in England or Wales is known as ‘dissolving’, or civil partnership dissolution.

This is done by applying to a court for a civil partnership dissolution order, along with the appropriate court fee (currently £593).

Applying for dissolution of civil partnership can only happen once your civil partnership has lasted for at least one year.

Furthermore, you must prove to the court that the civil partnership has ‘irretrievably’ broken down by citing one of the following four grounds (adultery is not available as an option to civil partners). *

  1. Your partner has behaved unreasonably
  2. You and your partner have lived apart for two years, and that you both agreed to the dissolution
  3. You and your partner have lived apart for at least five years, if only one of you agrees to the dissolution
  4. Your partner deserted you at least two years ago

Assuming the application is not contested, the court will then grant a conditional order (equivalent to the decree nisi in divorce). This will be followed up with a final order (equivalent to the decree absolute in divorce) that officially dissolves the civil partnership.

*A new law – No-fault Divorce – is set to end the ‘blame game’ when it comes into legal effect in England & Wales on 6 April 2022. The new law allows for a civil partnership dissolution without attributing fault or waiting on lengthy separation periods. See No-fault Divorce for further details.

To apply for a dissolution order you have to make an application to a designated civil dissolution court.
