Formal separation (legal separation) usually involves a separation agreement. A separation agreement or deed of separation sets out how finances, property, debts, and child arrangements will operate while you live apart.
Formal separation agreements can provide structure and clarity during separation, particularly when divorce is delayed for personal, religious, or financial reasons.
However, separation does not end the marriage. Financial claims between spouses remain open, including claims against property, pensions, savings, and future income.
A separation agreement is not automatically legally binding and cannot prevent future claims unless the court later approves the arrangements within a financial consent order on divorce.
Courts may consider a separation agreement as evidence of intention, especially when it was entered into freely with legal advice. Even so, it does not offer the same protection as a consent order.
