Scottish Divorce Service -Non simplified
This service is for residents of Scotland who have children under the age of 16
The grounds covered are
1 years or more separation with consent
2 years or more separation without consent.
You will be given assistance to prepare your own divorce writ using a template provided by us.
Once you have completed the writ you will be given full, step by step, guidance to allow you to process your own divorce.
E-mail and telephone support will be available 7 days a week and you will be able to follow the process without difficulty and without the need for legal knowledge or skills.
The support and guidance is given by a retired Scottish Solicitor acting as a Paralegal.
No court appearances are required and you will not need to employ the services of an expensive solicitor.
In addition to the fee payable to us you will have certain fees to third parties known as "outlays". Outlays are fees which are compulsory and which are not paid to us. If you are in receipt of certain benefits you may qualify for exemption from the fees paid to the court. Please ask for advice if you think this may apply to you. The outlays are :-
- An initial fee to the court of £120 to have the writ registered with the court;
- A fee of around £60 to a sheriff officer to serve the papers on your spouse;
- A fee to a notary public of around £40 to have affidavits signed; and
- A final fee of £55 to the court when applying for your decree of divorce. Even with these outlays you will be making a substantial saving on the fees normally charged by a solicitor.
On average the process, from start to finish, will take approximately 12 weeks.
