Please note that this website only deals with the law and procedures as it relates to the jurisdiction of England and Wales and Scotland unless specifically stated otherwise.

Whilst every precaution has been taken in compiling this service, neither Online Legal Services Limited, nor any contributors to the guides can be held responsible for any action (or the lack thereof) taken by any person or organisation, wherever they shall be based, as a result, direct or otherwise, of information contained in or accessed through the guide. Anyone using the guide is recommended to seek specific advice from a suitably qualified person before dealing with any situation which may be covered by any information contained in any part of the guides or before embarking on any course of action.

We hold professional indemnity insurance cover with Freelance Insure to one million pounds per claim.

Statutory consumer Rights

These terms and conditions do not affect your statutory rights whatsoever.

Divorce-Online will provide support from its offices by suitably experienced staff trained in divorce procedure to help you through the process of completing the fields in each document and to make minor amendments should you require it.

They are not legal advisers or solicitors and are not authorised by the company to give individual legal advice.

Delivery of Services

After completing the purchase, you will be taken to a page on the site where you can download the software package. This package has been security coded with a unique ID generated during the purchase.

This package should be saved to your hard drive. Once you have completed answering the questions in the software package, you must click on the 'Send details to Divorce-Online' button.

This will generate your documents within one working day. If you purchased the email package, we will email these to you immediately. If you purchased the printed package, we will print the documents and post them to you by first class post by the following day. They should therefore arrive within 1 week of you submitting your details us.

It is vital that you fill out the forms carefully, giving us your exact email and postal address, otherwise we may be unable to provide your documents in a timely manner.

Managed Divorce Services

In the event that your divorce or financial order becomes contested we will not be able to continue to assist with your service as the service is for uncontested divorces only. We will be unable to provide a refund as we operate on a fixed fee which covers any work we do up to the point of termination.

Refund Policy

Any customer who purchases our packages online is not eligible to cancel their order as transactions where the computer software is unsealed by the computer immediately on purchase are exempt under the Consumer Protection (Distance Selling) Regulations 2000.

However we will voluntarily provide a refund to you within 7 days of purchase as long as your documents have not been processed from our server and sent to you from our severs by email or post.

If the documents have left our email server or have been posted, then our liability for a refund ceases.

If you provide us with an unusable or incorrect email address or the email is not delivered or the post office fails to deliver, then we shall not be liable in those events.

Time Validity

Our LegalPac products are valid for a period of 6 months. After this period, the LegalPac service will expire and your details will be deleted from our database and you will have to purchase a new product at the price specified on the website at the date of the new purchase.

Shipping

We do not charge for shipping unless specified.

Handling Complaints

We pride ourselves on our customer service. Any issues raised with our support staff will be acknowledged and replied to by the next working day. If you still feel your problems are not being dealt with correctly, you may contact the Customer Service Manager at support@divorce-online.co.uk.

Commercial Use Limitation

The use of the Web site and the documents when downloaded by you are for your personal use only and will clearly on the face of them be shown to be licensed to you. You may not use the Web site or the documents for any other purpose except for your own personal use. You may however use the documents as many times as you wish. You may not remove the license or use the documents for any commercial purpose whatsoever and the copyright in them belongs to Online Legal Services Limited"OLS". You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products or services obtained from this Web site.

Re-use of the Documents

We recommend that you check our site regularly to ensure that the documents are the latest versions before reuse. If they are not and we have replaced them with revised versions we recommend that you upgrade to the latest version.

Limitation of Liability in respect of the Documents

We have included within this agreement a disclaimer in respect of our liability in respect of the documents. Please read it carefully as the following are the terms upon which we will provide the document to you.

Legal Document Service

If you use any document in the Divorce-Online service, it will be on the terms which are stated on this page.

What you are purchasing from us is a software product which has been prepared by experienced Family Lawyers in conjunction with Information Technology Specialists.

The software creates document templates for you based on the data you have personally entered into the fields of the LegalPac software.

Whilst we and our experts who have drafted the template documents have taken every care to ensure the accuracy of the contents of the documents, due to the continuing changing nature of the legal system the information contained in the documents will during the passage of time need to be updated. Therefore you must process your documents within 6 months of purchase.

We will do our best to ensure that the template documents are updated regularly to maintain their accuracy. We believe that the documents contain sufficient information to provide you with a starting point in the process of assembling a standard legal document. The documents are not suitable to provide legal advice or where any particular transaction will require the documents to be amended or altered save for spelling and grammatical errors.

The documents available on the Divorce-Online service have been prepared by the LegalPac software which you have completed yourself. What you are paying for is the use of our software and telephone supportthroughout the procedure.

What we are charging you for is the single use of our document creation software (LegalPac)in order for you to prepare your documents for your personal use.We do not give legal advice under any circumstances and do not represent you in any court. At all times you are a litigant in person and our role is as an address for service only.

If we write to Solicitors on your behalf, we do so as your litigation friend not as representatives.

Therefore the basis on which you purchase our software or make use of any template document is that the document is suitable to be used by you in conjunction with proper advice as to its application and adaptation for your particular requirements. The documents are not made available to you on any other basis. Please note also that the documents are prepared in compliance with the law of England and Wales. They will not be suitable in other parts of the UK or abroad. You should not use them if any person who is to sign the document or the property which the document deals with is outside England and Wales. We cannot be responsible if you do.

We will not have any liability to you at all if you use any document without obtaining appropriate legal advice as to its suitability for your particular requirements. Whatever advice you receive is the responsibility a solicitor or other authorised person advising you and we cannot in any way be responsible for it.

Nor will we have any responsibility at all for the alterations that may be made to the document after you have downloaded it or received it in any other way. Please note also that any responsibility that we may have to you will not extend to any of the following: First, loss or damage which we cannot reasonably foresee may happen. Secondly, loss or damage which consists of or includes any wasted expenditure, loss of profits or anticipated profits or gains of any description or loss of business.

If a court or any other body having the power to rule on disputes decides that any part of this Disclaimer is not reasonable or cannot be enforced for any reason, this will not affect the validity of the other parts of this Disclaimer which will continue to be in full force and effect.

A special note relating to the United States of America (USA) or Canada - because of the particular circumstances and nature of the legal systems of the USA and Canada, no document in the divorce Online service can be used in those countries or in connection with people or property in those Jurisdictions.

Consent Orders

Any documents drafted for you in relation to a consent order are done so by a qualified Solicitor in accordance with S.22(1) Solicitors Act 1974. however the disclaimer applies to these documents also in that you should obtain appropriate legal advice before proceeding to file any documents with the court. if you require details of the qualified Solicitor please email us

Privacy Policy

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

We will not email you in the future unless you have registered as a member of Divorce-Online, and elected to be kept informed of offers from us.

We will not pass your email address to other trusted traders unless you have registered as a member of Divorce-Online, and elected to be kept informed of offers from other companies.

Specifically, if you purchase documents from us, the information you supply to us will only be used to fulfill your order. We will not pass your details to anyone else, and we will not send you correspondence other than that related to the production of your documents.

In the case of DIY services your details will be deleted from our database after 6 months.
In the case of managed services, your details will be deleted from our database once your case has concluded and final documents have been sent to you. We do not under any circumstances keep copies of any documents or correspondance. All documents on file will be either deleted or schredded and disposed of securely.

The type of information we will collect about you includes:

address
phone number
email address
credit/debit card details (if you are purchasing documents)

We will never collect sensitive information about you without your explicit consent.

The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

The personal information which we hold will be held securely in accordance with our internal security policy.

     Managed divorce services - your details will be erased from our system when we send your final papers.

     DIY Divorce services - Your details will be erased from our system after 6 months.

     Community - Your details will be erased from our system upon request from you.

If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way can be used to identify you unless you modify your browser settings.

Community Area

Access and membership to the community area is provided at the absolute discretion of Online Legal Services Limited and maybe withdrawn at any time.

Use of the community area is on the basis that you will not post any offensive, defamatory or libelous material and Divorce Online reserves the absolute right to remove any material at any time for whatever reason without notice.

Any material considered to be offensive, libelous or defamatory should be reported to Divorce-Online who will then investigate the complaint and with the complainant decide on the best course of action. Failure to report in writing any material considered defamatory, offensive or otherwise will indemnify Divorce-Online and their 3^rd party partners from further action.

Experts

The Divorce-Online Experts Feature is intended to be for general information only and no reliance can be placed on any of the material published in the section and on the site generally and no liability shall attach to it in the event of any loss by virtue of the information given by orin respect of Online Legal Services Limited or any 3^rd party partner. You should take independent qualified legal advice before proceeding with any legal action or otherwise.

Calculators

Any calculator provided to users of the Web site is intended for guidance only and no reliance should be placed on the results of any calculations made by using the calculators before qualified legal advice has been taken which you are deemed to rely on and for which you agree to exclude Online Legal Services Limited and it’s 3^rd party partners and providers from liability.
